James Augustus Brauer, Machinegun Possession, Pennsylvania 2012

A Schuylkill County man has been charged with illegally possessing a fully functional unregistered machinegun and an unmarked and unregistered drop in auto sear.

James Augustus Brauer, 50, of Muir, Pennsylvania, was charged with two counts of illegal possession of a machinegun.

According to the United States Attorney’s Office for the Middle District of Pennsylvania, Brauer illegally possessed the machinegun and drop in auto sear on January 24, 2012, in Schuylkill County.

The investigation was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Pennsylvania State Police.

Brauer faces a maximum penalty of 10 years’ imprisonment, a three-year term of supervised release following imprisonment, and a $250,000 fine.

Assistant United States Attorney John Gurganus is prosecuting the case.

It is worth noting that indictments and criminal informations are only allegations, and all persons charged are presumed to be innocent unless and until found guilty in court.

Brauer’s case will be heard in court, and the outcome will determine the final sentence.
