A disturbing discovery in Machesney Park has led to the arrest of a 53-year-old man on a charge of possessing child pornography.
According to the allegations, James Umbaugh was found seated before a computer screen connected to a computer at his residence. What investigators found on that computer was nothing short of shocking – images and videos of child pornography, including prepubescent minors engaged in sexually explicit conduct.
The charge of possessing child pornography carries a minimum mandatory sentence of ten years in prison and up to a maximum of 20 years, along with a fine of up to $250,000. If convicted, the Court must impose a reasonable sentence under federal sentencing statutes and the advisory United States Sentencing Guidelines.
Umbaugh appeared before U.S. Magistrate Judge Iain D. Johnston and is currently in custody pending a hearing on pre-trial release.
The public is reminded that a complaint is only a charge and is not evidence of guilt. The defendant is presumed innocent and is entitled to a fair trial at which the government has the burden of proving guilt beyond a reasonable doubt.
The charge was announced by John R. Lausch, Jr., United States Attorney for the Northern District of Illinois, and Jeffrey S. Sallet, Special Agent-in-Charge of the Chicago office of the Federal Bureau of Investigation.
