A 29-year-old Porcupine man has been sentenced to 30 years in federal prison for the violent kidnapping and sexual assault of a middle-aged woman inside her own home. Jesse Miller’s attack, which unfolded on April 6, 2016, near Porcupine, South Dakota, left the victim battered, terrified, and fighting for escape.
On July 1, 2016, Miller pleaded guilty to one count of kidnapping. On October 26, 2016, Chief Judge Jeffrey L. Viken of the U.S. District Court delivered the sentence: 30 years in federal custody, followed by 5 years of supervised release. Miller was also ordered to pay a $100 special assessment to the Federal Crime Victims Fund.
According to court documents, Miller entered the woman’s residence and refused to let her leave. He grabbed her, hit and slapped her, dragged her from room to room while gripping her throat, and ultimately pushed her onto a bed where he sexually assaulted her. For an extended period, he held her against her will, restricting her movement through threats and physical force.
The victim’s chance came when Miller passed out on her bed. She fled barefoot through the night, running to a neighbor’s house for help. Her testimony and physical evidence provided crucial support for the federal case, which was prosecuted under federal jurisdiction due to the crime occurring on tribal land.
The investigation was led by the Bureau of Indian Affairs, Office of Justice Services, in coordination with the Oglala Sioux Tribe Department of Public Safety. Assistant U.S. Attorney Eric Kelderman handled the prosecution, emphasizing the brutality of the crime and the importance of justice for victims in Indian Country.
Immediately after sentencing, Jesse Miller was remanded into the custody of the U.S. Marshals Service. The case underscores the federal government’s ongoing efforts to address violent crime in tribal communities, where jurisdictional complexities often delay justice—but not this time.
