John Afriyie, Securities and Wire Fraud, New Jersey 2024

John Afriyie, a 29-year-old investment analyst from Freehold, New Jersey, was found guilty in Manhattan federal court of securities fraud and wire fraud after stealing confidential information to rake in $1.5 million through illegal stock trades. The verdict, delivered by a unanimous jury, ends a high-stakes trial rooted in deception, digital cover-ups, and a brazen attempt to impersonate his own mother on recorded calls.

Afriyie, once employed at a Manhattan-based private investment fund, accessed material nonpublic data from his employer’s secure server in January 2016, learning of Apollo Investment Management LLC’s planned acquisition of ADT Corporation. Despite being bound by strict confidentiality policies, he exploited the intelligence, executing 28 trades over two weeks—buying 2,279 ADT call options for just $24,254.02 through a brokerage account under his mother’s name, which he controlled entirely.

The stock’s value exploded after the public announcement of the acquisition, jumping from $29.20 to $39.64 per share. Afriyie’s options surged in value, netting him over $1.5 million in illicit profits when he sold. To hide his tracks, he repeatedly impersonated his mother during recorded phone calls with his broker—a farcical lie the jury swiftly rejected.

When confronted by FBI agents, Afriyie doubled down, lying under oath and insisting that his voice on the broker recordings was his mother’s. After his arrest, he attempted to erase digital evidence by deleting emails used to coordinate the trades—a move prosecutors highlighted as proof of guilt. His refusal to appear in court on January 23, 2016, led to his immediate remand; he remains in federal custody.

The conviction carries a statutory maximum of 20 years in prison for each count—securities fraud and wire fraud. Though the guilt phase is complete, a jury will now determine whether specific assets are forfeitable as proceeds of the crime. That hearing resumes tomorrow and could further dismantle Afriyie’s financial gains.

Manhattan U.S. Attorney Preet Bharara stated: “As a unanimous jury found today, John Afriyie made $1.5 million in illegal profits by trading in ADT stock, using inside information about ADT that he had obtained from the fund’s servers. To cover up his insider trading scheme, Afriyie destroyed incriminating emails and even claimed his own voice on a recorded call to his broker was actually his mother’s. The jury saw through Afriyie’s deception, and he now stands convicted of federal crimes.”
