BUFFALO, N.Y. – A local business owner was handed a prison sentence for a serious financial crime that left the government with a hefty bill.
John C. Creighton, 57, of Bemus Point, N.Y., was sentenced to 12 months in prison by Chief U.S. District Court Judge William M. Skretny for failing to pay payroll taxes. In addition to the prison time, Creighton was also ordered to pay $663,627 in restitution to the IRS.
Court documents reveal that Creighton is the president and owner of Classic Brass Inc. in Lakewood, N.Y. In 2010 and 2011, he withheld payroll taxes from the paychecks of his employees, but failed to make the necessary payments to the IRS. Furthermore, he neglected to file the required Forms 941 regarding the payment of payroll taxes.
The investigation into Creighton’s financial dealings was led by the Special Agents of the Internal Revenue Service – Criminal Investigation Division, under the direction of Special Agent-in-Charge Toni M. Weirauch. The sentencing is a culmination of the probe, which aimed to hold Creighton accountable for his actions.
Assistant U.S. Attorney Trini E. Ross, who handled the case, emphasized that Creighton’s actions had significant consequences for the government. ‘He withheld payroll taxes from his employees, but failed to pay them to the IRS, resulting in a substantial loss for the government,’ Ross stated.
The case serves as a reminder of the importance of adhering to tax laws and regulations. ‘Payroll tax evasion is a serious offense that can have severe consequences for individuals and businesses,’ Ross added.
The sentencing of John C. Creighton sends a clear message that those who engage in financial crimes will be held accountable for their actions.
