Jose Deciderio Alvarado-Cardoza, 31, a citizen of Honduras, is back in federal crosshairs — charged with illegally reentering the United States after prior deportation, according to a one-count indictment unsealed today by the Department of Justice.
The indictment, filed in federal court in Louisiana, alleges that on February 26, 2018, Alvarado-Cardoza crossed into the U.S. after having been formally removed. The charge, under Title 8 United States Code, Section 1326(a), is a federal felony carrying a maximum prison sentence of up to two years, a fine of up to $250,000, a mandatory $100 special assessment, and a maximum of one year of supervised release if convicted.
U.S. Attorney Duane A. Evans confirmed the charges, stressing that while the indictment marks a formal accusation, it does not equate to guilt. “The indictment is merely a charge,” Evans stated, “and the guilt of the defendant must be proven beyond a reasonable doubt in a court of law.”
Alvarado-Cardoza’s case underscores ongoing federal efforts to prosecute non-citizens who reenter the country illegally after removal. Such prosecutions are a cornerstone of immigration enforcement, often pursued when individuals have prior criminal records or enter without inspection.
The investigation was conducted by U.S. Department of Homeland Security and Immigration and Customs Enforcement (ICE), agencies at the forefront of tracking and apprehending deported nationals who return unlawfully. Prosecution is being handled by Assistant United States Attorney Spiro Latsis, a veteran in immigration and border crime cases.
Alvarado-Cardoza remains in federal custody as the legal process moves forward. The case is part of a broader pattern of federal actions targeting illegal reentry — a crime that, while non-violent on its face, carries stiff penalties under U.S. law.
