Illegal Reentry Lands Jose Del Carmen Hernandez Hernandez 3 Years
Jose Del Carmen Hernandez Hernandez, a 43-year-old citizen of Mexico, has been sentenced to 3 years in federal prison for his third illegal reentry offense.
Hernandez, who last resided in Hartford, Connecticut, was sentenced by U.S. District Judge Jeffrey A. Meyer on no date specified to 48 months of imprisonment, followed by 3 years of supervised release.
According to court documents, Hernandez has never held legal status in the U.S. and has sustained multiple state convictions, including assault, threatening, and operating under the influence. He was removed to Mexico in April 2009, but unlawfully reentered the U.S. and returned to Connecticut.
Hernandez was arrested in Hartford in March 2013 on breach of peace and criminal mischief offenses and was subsequently charged and convicted in federal court of reentry of a removed alien. He was sentenced to 12 months of imprisonment on September 10, 2013.
In November 2015, Hernandez was arrested by Hartford Police for driving under the influence and was convicted in federal court of reentry of a removed alien. He was sentenced to 12 months and one day of imprisonment, followed by 3 years of supervised release.
Hernandez has been detained since his arrest on January 11, 2018, for multiple motor vehicle violations, including operating under the influence.
The case was investigated by the U.S. Department of Homeland Security, Immigration and Customs Enforcement and was prosecuted by Assistant U.S. Attorney Deborah R. Slater.
The defendant’s driving under the influence case is pending in state court.
