EL PASO, Texas – A Mexican national with a violent past is behind bars after being arrested in El Paso on criminal charges related to his alleged illegal re-entry into the United States.
José Juan Garcia Tiro, a 47-year-old Mexican national, is facing one count of illegal re-entry, a charge that carries a maximum sentence of up to 10 years in prison if convicted.
Garcia Tiro has a violent criminal record that dates back to 2007, when he was convicted in Ocean, New Jersey for sexually assaulting a prepubescent minor. He was sentenced to eight years in prison for the heinous crime.
According to court documents, Garcia Tiro was determined to be in the United States illegally after his arrest. He had previously been removed from the country to Mexico on April 23, 2015.
Garcia Tiro was ordered to be detained without bond in a February 10 hearing, a decision that will likely keep him behind bars until his trial.
The case is being investigated by the U.S. Border Patrol and prosecuted by Assistant U.S. Attorney Patricia Aguayo.
A federal district court judge will ultimately determine Garcia Tiro’s sentence after considering the U.S. Sentencing Guidelines and other statutory factors.
A criminal complaint is merely an allegation, and all defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
This is not Garcia Tiro’s first run-in with the law, and it remains to be seen whether he will face any additional charges for his alleged crimes.
