José Melchor Martinez, a 49-year-old Mexican national, has been sentenced to serve 18 months in federal prison for immigration violations. Martinez, who was formerly on ICE’s Most Wanted list, pleaded guilty to illegal reentry of a removed alien.
Martinez’s sentencing was announced by United States Attorney David C. Joseph. The sentencing was carried out by U.S. Chief District Judge S. Maurice Hicks Jr. Martinez pleaded guilty on January 30, 2019, and was sentenced on a later date.
At the time of his arrest near Church Point, Louisiana, on October 12, 2018, Martinez was considered one of ICE’s most wanted fugitives. He had been removed from the United States on September 6, 2003, via the Hidalgo, Texas, port of entry. The removal followed a 2002 conviction in Mecklenburg County, North Carolina, for indecent liberties with a child.
After serving time for the conviction, Martinez was removed from the United States but later returned on an unknown date. His return to the United States was a violation of the law, and he now faces deportation upon finishing his 18-month prison term.
The case was investigated by U.S. Immigrations and Customs Enforcement Removal, Office of Enforcement and Removal Operations. Assistant U.S. Attorney David J. Ayo prosecuted the case. Martinez’s sentencing serves as a reminder of the consequences of violating immigration laws and the importance of enforcing these laws to protect public safety.
The fact that Martinez was able to return to the United States after being removed raises questions about the effectiveness of current immigration laws and the measures in place to prevent such violations. The case highlights the need for continued efforts to strengthen immigration enforcement and prevent illegal reentry.
In a statement, United States Attorney David C. Joseph emphasized the importance of enforcing immigration laws and the role of law enforcement agencies in protecting public safety. The sentencing of José Melchor Martinez is a significant step in this effort, and it serves as a warning to those who would seek to violate these laws.
