Joseph P. Martinelli, 64, of Kenvil, New Jersey, admitted today to conspiring with a former fire inspector to extort $15,000 from a real estate developer through threats of physical violence. The plea, entered in Newark federal court, exposes a raw, street-level brand of strong-arm intimidation not often seen in modern white-collar circles—but all too real in the shadows of North Jersey’s construction and development world.

Martinelli pleaded guilty to one count of conspiracy to commit extortion by threats of force, violence, and fear, admitting he schemed with Billy A. Donnerstag, 49, of Hackettstown, a former fire inspector for Middlesex Borough and other municipalities. The charge carries a maximum penalty of 20 years in prison and a $250,000 fine—or twice the gross gain from the offense. U.S. District Judge Madeline Cox Arleo accepted the plea.

According to court documents and statements made during the hearing, from December 2016 through June 2017, Martinelli and Donnerstag targeted the owner and operator of a real estate development and construction company, referred to as ‘Individual 1’ in court filings. Their excuse? A property Martinelli sold to the victim in 2007—now, nearly a decade later, they claimed the buyer hadn’t paid enough.

But this wasn’t a contract dispute. It was a shakedown. In multiple phone calls and face-to-face meetings, Martinelli and Donnerstag made clear: pay up, or suffer physical harm. Donnerstag, armed with the authority of his public position, was presented as the enforcer. The threats were not veiled—they were direct, personal, and designed to instill fear.

The duo collected $15,000 in cash during two separate meetings. The money, however, was FBI-supplied. The entire operation was part of a controlled investigation, turning the extortionists’ greed into their undoing. No actual harm came to the victim, but the intent—to intimidate, to coerce, to profit from fear—was undeniable.

Sentencing is scheduled for June 12, 2018. Assistant U.S. Attorney Lee M. Cortes Jr. is prosecuting the case, with the FBI, under Special Agent in Charge Timothy Gallagher, leading the investigation. Donnerstag remains charged by indictment and is presumed innocent unless proven guilty. Martinelli is represented by Brian N. DiGiacomo, Esq., of Madison, New Jersey.
