SOUTH BEND, Ind. – A Rochester man is headed to federal prison after admitting to a brazen theft that flooded the streets with stolen firearms. Justin Overholser, 40, was sentenced to 33 months behind bars by U.S. District Court Judge Jon E. DeGuilio following a guilty plea, authorities announced Thursday.
The September 2021 break-in at a local federal firearms licensee wasn’t a smash-and-grab; it was a calculated raid. Overholser didn’t just steal guns, he ransacked the store, causing over $2,000 in damage. He made off with a haul valued at over $10,000 – eleven firearms and a significant quantity of ammunition. The impact on the community could have been catastrophic, officials say.
But the story doesn’t end with the burglary. Overholser didn’t stash the weapons. He immediately began selling them, trading stolen firearms for drugs and cash. This fueled further criminal activity, turning stolen property into a means to support a destructive lifestyle. The ATF investigation quickly linked Overholser to the illicit sales.
The Bureau of Alcohol, Tobacco, Firearms and Explosives led the investigation, with crucial assistance from the Indiana State Police and the Logansport Police Department. Their combined efforts tracked the stolen firearms and ultimately led to Overholser’s arrest and conviction. Assistant U.S. Attorneys Joel Gabrielse and Katelan McKenzie Doyle prosecuted the case.
Federal officials are touting this case as a win for Project Safe Neighborhoods (PSN), a program aimed at reducing violent crime and gun violence. But for those living in communities plagued by illegal firearms, PSN rhetoric rings hollow without tangible results. This sentencing, while significant, is just one battle in a larger war.
Overholser will serve his 33-month sentence, followed by two years of supervised release. Whether that’s enough to deter similar crimes remains to be seen.
