STILLWELL, OK – In a stunning turn of events within the Eastern District of Oklahoma, Kimberly Dawn Ball-Gilbert, 43, has been sentenced to 97 months in prison for Voluntary Manslaughter in Indian Country. The sentence was announced by the United States Attorney’s Office following a federal investigation.
Ball-Gilbert, also known as Kimberly Dawn Gilbert and Kimberly Ball, pleaded guilty on March 19, 2025, for her role in a violent incident that left one man dead. On July 17, 2023, she participated in a brutal beating alongside Mose Adam Smith, which resulted in fatal injuries to the victim.
Following the assault, Ball-Gilbert and Smith stole the victim’s truck and fled to Illinois. They were apprehended ten days later by law enforcement, thanks to a collaborative effort involving multiple agencies, including the FBI and local sheriff’s offices.
Mose Adam Smith was also found guilty of Voluntary Manslaughter in Indian Country and sentenced to 121 months in prison. His sentencing occurred on September 17, 2025, following a federal jury trial.
The crime took place within the Sequoyah County boundaries, which fall under the Cherokee Nation Reservation. The Honorable Ronald A. White presided over the hearing held in the United States District Court for the Eastern District of Oklahoma.
Ball-Gilbert will remain in the custody of the U.S. Marshals Service until she is transported to a designated Bureau of Prisons facility, where she will serve her non-paroleable sentence. Assistant U.S. Attorneys Patrick M. Flanigan and Lewis M. Reagan represented the United States in this case.
