Kay F. Gow, Conspiracy to Embezzle Funds, Florida 2024

FORT MYERS, FL – Three individuals are facing federal charges today after allegedly orchestrating a brazen scheme to siphon over $5.1 million in taxpayer funds from Lee County. Kay F. Gow (66, Naples), Robert T. Gow (75, Naples), and John G. Williams, Jr. (65, Virginia Beach, VA) have been indicted on charges of conspiracy to commit wire fraud and money laundering, wire fraud, and illegal monetary transactions.

According to the indictment unsealed today, the Gows, operating through entities like HerbalScience Group, LLC and HerbalScience Singapore Pte, Ltd, formed VR Laboratories, LLC in 2010. Their goal? To snag a $5 million grant from Lee County’s Financial Incentives for Recruiting Strategic Targets (FIRST) program – a fund designed to boost economic development in the Ft. Myers area. The Gows allegedly built a house of cards, making “numerous false and fraudulent representations” about the financial health of their companies and the promised potential of VR Labs, painting a picture of a future botanical pharmaceutical powerhouse.

Lee County bit, awarding VR Labs the full $5 million to construct a manufacturing facility that was supposed to deliver “hundreds of high-paying jobs” and economic growth. But the facility never materialized. Instead, the Gows brought in John G. Williams, Jr., a long-time friend with no actual experience in manufacturing, and registered a shell company, “Williams Specialty Bottling Equipment.” The Gows falsely claimed Williams would supply the bottling line, then used fabricated invoices from his fictitious company to justify payments from the grant funds. Williams, in turn, allegedly kicked back a “substantial portion” of the money to the Gows and VR Labs.

The scheme continued with the Gows fraudulently transferring the grant money to their own entities, disguised as fees, salaries, and expenses. They created more fictitious entities and documents in a desperate attempt to conceal the source of the kickbacks. To date, Lee County has disbursed approximately $4.7 million to VR Labs, and the promised manufacturing facility remains just a ghost of a project. The indictment seeks forfeiture of the entire $5.1 million as proceeds of the alleged crimes.

If convicted on all counts, the Gows each face a maximum penalty of 45 years in federal prison, while Williams faces a maximum of 25 years. All three defendants are scheduled to make their initial appearances at 3:00 p.m. today before United States Magistrate Judge Carol Mirando. An indictment is not a conviction. Each defendant is presumed innocent until proven guilty in a court of law.
