CHARLESTON, W.V. – A Logan County man has been sentenced to five years of probation and ordered to pay $230,000 in restitution for his involvement in a kickback scheme involving Arch Coal subsidiary Mingo Logan Coal Company, announced United States Attorney Carol Casto.
Chadwick Lusk, 35, of Davin, pleaded guilty to honest services mail fraud. The sentence was imposed by United States District Judge Thomas E. Johnston.
Lusk admitted to defrauding Mingo Logan Coal Company while employed as a purchasing agent at the Mountain Laurel Mining Complex. He accepted illegal cash kickbacks for crib blocks, which are used for roof support in underground mines. Gary L. Roeher, owner of CM Supply, Co., paid Lusk 7.5% of the crib block sales price, with estimates totaling approximately $230,000 over a period from September 2009 to March 2014.
The investigation into this scheme was conducted by the FBI, United States Postal Inspection Service, and West Virginia State Police. Assistant United States Attorney Meredith George Thomas led the prosecution.
