NEW YORK – A hail of gunfire on Manhattan’s Lower East Side last December proved fatal for Kent Edwards, and now, a year later, New York Attorney General Letitia James’ Office of Special Investigation (OSI) has released a report clearing the NYPD officers involved. The report, released May 19, 2025, details a tense standoff that ended with Edwards dead and no criminal charges forthcoming.
The incident unfolded on December 14, 2023, when officers from the Manhattan Warrant Section arrived at a residence to apprehend Edwards, a suspect in an October 18, 2023 shooting that injured one person. According to the OSI report, upon arrival, officers were immediately informed by a woman at the door that Edwards was inside and armed with a firearm. The woman, along with a second individual, quickly exited the apartment, leaving officers to attempt communication with the suspect.
For two grueling hours, officers pleaded with Edwards to surrender peacefully, but their efforts were met with silence. The report states that officers cautiously advanced a few feet into the apartment before Edwards suddenly emerged from a hallway and opened fire, discharging his weapon four times in the direction of the officers. An officer returned fire, striking Edwards.
Paramedics rushed Edwards to a local hospital, but he was pronounced dead. The OSI investigation meticulously reviewed body-worn camera footage, conducted interviews with all involved officers and witnesses, and performed a thorough legal analysis. The central question: was the officer’s use of deadly force justified? Under New York law, an officer is permitted to use deadly force when they reasonably believe it’s necessary to defend against the imminent threat of deadly force from another individual.
The OSI report concludes that, given the circumstances – the prior shooting Edwards was suspected of, the direct warning he possessed a gun, and his act of firing upon officers – a prosecutor would be unable to prove beyond a reasonable doubt that the officer’s actions were unlawful. “Under these circumstances…a prosecutor would not be able to disprove beyond a reasonable doubt at trial that the officer’s use of deadly physical force against Mr. Edwards was justified,” the report states. As a result, OSI has determined that criminal charges will not be pursued in this matter.
The case underscores the precarious and often split-second decisions officers face in high-stakes confrontations. While the report offers legal justification for the shooting, it doesn’t erase the tragic outcome. The investigation remains a stark reminder of the ever-present dangers faced by both law enforcement and those caught in the crosshairs of violent crime on the streets of New York City.
