Lynnwood Man Sentenced for Assaulting Cops on Jan. 6
Tucker Weston, a 35-year-old Washington state man, was sentenced to 24 months in prison for his role in the violent assault of law enforcement officers during the January 6, 2021, breach of the U.S. Capitol.
Weston, a resident of Lynnwood, Washington, pleaded guilty on July 31, 2023, to two felony charges: civil disorder and assaulting, resisting, or impeding certain officers. U.S. District Judge Reggie B. Walton sentenced Weston to 24 months in prison, 36 months of supervised release, and ordered him to pay $2,000 in restitution.
According to court documents, Weston traveled from Seattle to Washington, D.C., to attend the “Stop the Steal” rally at the Ellipse and protest the results of the 2020 presidential election. On the morning of January 6, 2021, Weston attended the rally and, afterward, marched with other protestors toward the U.S. Capitol.
As the rioters approached the Capitol building, Weston participated in removing a metal barricade on the Capitol grounds, enabling rioters to advance closer to the building. He then shoved officers who were trying to prevent the rioters from progressing any closer to the Capitol building.
Weston’s actions continued to escalate throughout the day. He was sprayed with oleoresin capsicum (OC) spray but refused to back away from the police line. He later joined with a group of rioters in using a bike rack to push against law enforcement. During his two hours on the West Plaza, Weston witnessed other rioters push, punch, and use pepper spray against officers.
The FBI arrested Weston on October 19, 2022, in Lynnwood. The U.S. Attorney’s Office for the District of Columbia and the Department of Justice National Security Division’s Counterterrorism Section prosecuted the case, with valuable assistance from the U.S. Attorney’s Offices for the Western District of Washington.
This case serves as a reminder of the violent and destructive nature of the January 6, 2021, breach of the U.S. Capitol. As the investigation continues, it’s clear that those responsible for the violence will be held accountable for their actions.
