Mallory Brown, Gun Smuggling, California 2023

MISSOULA – Mallory Nehemiah Brown, a 44-year-old Auburn, Washington man, has been sentenced to 115 months in prison for illegally possessing firearms. This comes after his guilty plea in January 2025 for one count of prohibited person in possession of a firearm.

Brown’s criminal history includes a bank robbery conviction from June 9, 2004, in the Eastern District of California. He served 51 months in prison and another 36 months of supervised release, during which he was explicitly forbidden from owning, possessing, or having access to firearms or ammunition.

The fateful incident began on January 8, 2024, when Brown boarded an Amtrak train in Seattle with a black duffel bag and several long boxes. By the next day, Brown had been removed from the train in Libby, Montana, following a complaint by fellow passengers. Inside the bags: four firearms, ammunition, magazines, a suppressor, eight firearms receivers, night vision goggles, a tactical vest, and more.

Brown denied the ownership of the weapons but was identified as the person who loaded the bags onto the train. A shipping label on one box addressed to “Mallory Brown” sealed his fate.

U.S. Assistant District Attorney Brian Lowney prosecuted the case, with the ATF, FBI, Libby Police Department, Lincoln County Sheriff’s Office, and Montana Probation and Parole conducting the investigation. This sentencing underscores the commitment of Project Safe Neighborhoods to reduce violent crime and gun violence across communities.
