Ace Makes Him First, 38, of Little Eagle, South Dakota, has pleaded guilty to Domestic Assault By A Habitual Offender, a federal charge.
The maximum penalty for this conviction is 5 years’ imprisonment, a $250,000 fine or both, and a period of supervised release of 3 years.
The charges stem from an altercation in December 2011, when Makes Him First got into a fight with his domestic partner, striking her about the head and face. The victim’s lip became swollen and split as a result of the assault.
Makes Him First has a history of violent behavior, having been convicted of similar offenses against the same victim in Standing Rock Tribal Court.
The investigation was conducted by the Bureau of Indian Affairs, Standing Rock Agency, and the case is being prosecuted by Assistant U.S. Attorney Troy Morley.
A presentence investigation has been ordered, and a sentencing date has been set for July 22, 2013. Makes Him First was remanded to the custody of the U.S. Marshal pending sentencing.
U.S. Attorney Brendan V. Johnson announced the guilty plea, which is the result of a thorough investigation and prosecution by federal authorities.
The case is a reminder that domestic violence is a serious crime that will be prosecuted to the fullest extent of the law in federal court.
