Fresno Man Charged with Felon in Possession of Ammunition
A 48-year-old Fresno man has been indicted for being a felon in possession of ammunition, according to a federal indictment announced by Acting U.S. Attorney Phillip A. Talbert.
Marc Davis was charged with one count of being a felon in possession of ammunition after a loaded, unserialized AR-15 style rifle was found in his possession during an argument with another man on March 21, 2021.
Davis has multiple prior felony convictions, including convictions for infliction of corporal injury on a spouse or cohabitant and second degree burglary, according to court documents.
The investigation into Davis was led by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Fresno Police Department. Assistant U.S. Attorney Kimberly A. Sanchez is prosecuting the case.
If convicted, Davis faces a maximum statutory penalty of 10 years in prison and a $250,000 fine. However, any sentence would be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines.
The charges against Davis are only allegations, and he is presumed innocent until and unless proven guilty beyond a reasonable doubt. This case is being prosecuted as part of the joint federal, state, and local Project Safe Neighborhoods Program, which aims to reduce violent crime in the community.
The Project Safe Neighborhoods Program is a proven strategy that focuses enforcement efforts on the most violent offenders and partners with locally based prevention and reentry programs to achieve lasting reductions in crime.
