WIRE FRAUD CHARGE ROCKS SAN DIEGO DEVELOPER
Mark Hofmann, a 55-year-old real estate developer from San Diego, California, has been charged with wire fraud in a Louisiana court. According to the Bill of Information, Hofmann allegedly misappropriated approximately $404,000 from investors in a project to develop two office buildings in Covington, Louisiana.
The scheme, which began in late 2008, involved Hofmann seeking investors to put up approximately $3,000,000 for the acquisition of a five-acre tract of land adjacent to the Lakeview Regional Medical Center. Ultimately, Hofmann and his partner convinced Bolivar Investors Group, L.L.C. to invest the money, and the two created a new entity, "Newtrac West," to facilitate the purchase and development.
However, Hofmann allegedly withdrew funds from the Newtrac West account without authorization and used them to repay his personal expenses and debts. The Bill of Information alleges that this occurred on at least 24 occasions between January 26, 2009, and December 14, 2009.
Hofmann and his partner also created doctored bank statements to hide the unauthorized withdrawals and deceive representatives of Bolivar. These statements were provided to Bolivar’s representatives regularly, further deceiving them into believing that Newtrac West was in excellent financial condition.
United States Attorney Dana J. Boente reiterated that the Bill of Information is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt. If convicted, Hofmann faces a maximum term of imprisonment of not more than 20 years, followed by up to 3 years of supervised release, and a $250,000 fine.
The case was investigated by the Federal Bureau of Investigation and is being prosecuted by Assistant United States Attorney Jordan Ginsberg.
Hofmann’s alleged scheme has sent shockwaves through the business community, raising questions about the accountability of developers and investors. The case is a stark reminder of the importance of due diligence and the need for transparency in financial dealings.
