Yacht Captain Sentenced to 33 Months in Prison for Neglect Resulting in Death
A tragic incident on a luxury yacht has resulted in the conviction of its captain, Mauricio Alvarez, who has been sentenced to 33 months in prison for misconduct or neglect resulting in death. Alvarez was found guilty of violating Title 18, United States Code, Section 1115, which prohibits misconduct or neglect of a ship officer that results in the death of an individual.
The incident occurred on April 1, 2018, when Alvarez was captain of the 91-foot performance yacht MIAMI VICE. During a paid charter, Alvarez drove the yacht at a high rate of speed and beached it on Monument Island. However, he failed to ensure that everyone on board was accounted for before leaving the island. In a reckless move, Alvarez started the yacht’s 4500 horsepower engines and accelerated in reverse, directly towards the victim, who was swimming in the water. The victim was caught in the yacht’s propellers and killed.
Alvarez’s recklessness was not his only issue. He was also found to have been heavily using cocaine during his time as captain. In fact, he was filmed using cocaine by the yacht’s owner, Laurent Marc-Antoine Jean Maubert-Cayla, as recently as March 29, 2018.
Alvarez’s behavior was a clear disregard for the safety of those on board the yacht. His actions resulted in the tragic loss of life, and he will now face the consequences of his actions. The sentencing of Alvarez serves as a reminder of the importance of prioritizing safety and following the law.
The case against Alvarez was prosecuted by Assistant U.S. Attorney Daniel J. Marcet and Coast Guard Special Assistant U.S. Attorneys Phil Jones and Emily Rose. U.S. Attorney Ariana Fajardo Orshan commended the investigative efforts of the Coast Guard Investigative Service in this matter.
