DALLAS, TX – A Texas contractor was sentenced in 2007 after knowingly exposing workers and the public to dangerous asbestos fibers during a demolition project in Addison, Texas. Melvin Eugene Riecke II was found guilty on four federal counts related to the illegal handling and disposal of asbestos-containing materials, a blatant disregard for both public health and environmental regulations.
According to court documents, Riecke and his crew demolished a former lumber and hardware store between November 6 and December 10, 2001. A pre-demolition survey had clearly identified the presence of asbestos within the building, yet Riecke failed to implement any of the legally mandated safety protocols for asbestos removal. Instead of carefully containing and disposing of the hazardous material, Riecke directed his crew to dump it at an unauthorized site in West Dallas, effectively contaminating the area and putting nearby residents at risk.
The case, investigated by the Environmental Protection Agency’s (EPA) Criminal Investigation Division, revealed Riecke had signed a contract with Beltway Development Company explicitly requiring adherence to all applicable asbestos removal laws. This contract was flagrantly violated, demonstrating a deliberate effort to cut corners and prioritize profit over safety. The improper handling of asbestos created a significant health hazard, as inhalation of asbestos fibers is directly linked to severe respiratory illnesses, including lung cancer, asbestosis, and mesothelioma – a particularly aggressive form of cancer.
Riecke was initially charged on July 6, 2006, with a superseding indictment encompassing a total of four counts. These included one count of making false statements (18 U.S.C. 1001), one count of mail fraud (18 U.S.C. 1341), and two counts of violating the Clean Air Act (42 U.S.C. 7412(f)(4)). The charges stemmed from his failure to properly manage hazardous air pollutants during the demolition process, and his subsequent misrepresentations regarding compliance.
Following a trial, Riecke was convicted on all four counts on January 31, 2007. The judge sentenced him to 15 months of incarceration, followed by 24 months of probation. In addition to imprisonment, Riecke was ordered to pay a $400 special assessment fee and $1,604 in restitution to Beltway Development Company for the costs associated with the improper demolition. This case serves as a stark reminder of the severe consequences for those who deliberately flout environmental regulations and endanger public health.
