Juan Bautista-Rubio, Aggravated Identity Theft, IA, 2023

21-year-old Juan Bautista-Rubio, a Mexican illegal alien living in Cedar Falls, Iowa, has been convicted of aggravated identity theft following a swift two-day trial in federal court in Cedar Rapids. The jury’s guilty verdict came after approximately two hours and thirty minutes of deliberation.

Bautista-Rubio, who previously pleaded guilty to illegal re-entry into the United States and unlawful use of identification documents, used a stolen social security card and fake permanent resident alien card to secure employment in Waterloo, Iowa. He worked under false pretenses from April 2012 through June 2013, and again from December 2013 through April 2014.

On April 23, 2014, Bautista-Rubio confessed to Homeland Security agents that he was living in the United States illegally after being deported in 2011. He admitted using another person’s identification to gain employment, stating that he specifically requested those documents to ensure his ability to work here.

The sentencing hearing before Chief Judge Linda R. Reade is pending, with Bautista-Rubio currently in custody of the United States Marshal. The defendant faces a mandatory two-year sentence for aggravated identity theft, along with up to ten years for illegal re-entry and additional fines totaling over $750,000.
