Illegal Entry Lands Mexican National in Jail
Pedro Fernandez-Garcia, 40, a citizen of Mexico, has been sentenced to six months imprisonment for reentering the United States illegally. U.S. District Judge Sarah S. Vance handed down the sentence in federal court, announced U.S. Attorney Dana Boente.
Fernandez-Garcia was found guilty of knowingly and unlawfully reentering the United States on December 5, 2012, without the consent of the Attorney General or Secretary of Homeland Security. This is a serious offense, and Fernandez-Garcia will face the consequences.
According to court documents, Fernandez-Garcia had previously been removed from the United States and had not received permission to reapply for admission. His sentence was enhanced due to a previous felony conviction.
U.S. Immigration and Customs Enforcement, Enforcement and Removal Operations, investigated the case, and Special Assistant U.S. Attorney Robert Weir prosecuted the matter. Fernandez-Garcia will be placed on three years of supervised release following his imprisonment, during which time he will be under federal supervision and risks an additional term of imprisonment if he violates any terms of supervised release.
