Mexican National Sentenced for Illegal Reentry
Luis Baena-Olivares, a 52-year-old Mexican national, faces 37 months in prison for violating immigration laws after being found in Jefferson Parish, Louisiana, without proper clearance.
U.S. Attorney Dana J. Boente announced that Baena-Olivares was sentenced by U.S. District Judge Jay C. Zainey to 37 months imprisonment, followed by three years of supervised release. During this time, Baena-Olivares will be under federal supervision and risks an additional term of imprisonment if he violates any terms of supervised release.
According to court documents, Baena-Olivares pled guilty to a one-count indictment admitting he was an alien who was previously removed and was knowingly and unlawfully found in the United States, in Jefferson Parish, Louisiana on December 18, 2012, without the Attorney General or Secretary of the Department of Homeland Security, having expressly consented to his re-application for admission into the United States.
The case against Baena-Olivares was investigated by United States Immigration and Customs Enforcement – Enforcement and Removal Operations and the Jefferson Parish Sheriff’s Office. The case was prosecuted by Special Assistant United States Attorney Robert Weir.
Baena-Olivares’s sentence was subject to enhancement based on a previous aggravated felony conviction, which significantly contributed to his lengthy prison term.
The case serves as a reminder of the consequences of violating immigration laws and the importance of adhering to the rules and regulations set forth by the federal government.
Baena-Olivares is currently in custody and will begin serving his sentence once he has been processed by the U.S. Marshals Service.
