West Virginia Man Charged with Armed Career Criminal Act
MARTINSBURG, WEST VIRGINIA – A Martinsburg man was taken into custody today for a firearm violation, Acting United States Attorney Betsy Steinfeld Jividen, announced.
Michael Eugene Decker, age 37, of Martinsburg, West Virginia, was indicted on February 22, 2017 by a federal grand jury sitting in Elkins for "Armed Career Criminal Act." The crime is alleged to have occurred on December 1, 2016 in Berkeley County.
According to the indictment, Decker could face severe penalties, including at least fifteen years in prison and a fine of up to $250,000. Under the Federal Sentencing Guidelines, the actual sentence imposed will be based upon the seriousness of the offenses and the prior criminal history, if any, of the defendant.
Assistant U.S. Attorney Lara K. Omps-Botteicher is prosecuting the case on behalf of the government. The Bureau of Alcohol, Tobacco, Firearms and Explosives investigated. This is a collaborative effort to keep our communities safe.
An indictment is merely an accusation. A defendant is presumed innocent unless and until proven guilty.
In this case, Decker is accused of violating federal firearm laws, and the investigation is ongoing. The public is encouraged to report any suspicious activity to the authorities.
