Miguel Aviles, Unlawful Firearm Possession, New Jersey 2021

A Union County man is facing serious time behind bars after pointing a gun at two victims and firing it inside their residence, authorities say.

The incident occurred on August 27, 2021, in Elizabeth, New Jersey, when Miguel Aviles, 47, allegedly pointed a gun at two victims, threatened to shoot them, and then fired the weapon. Two other occupants of the residence confirmed hearing the shot, according to documents filed in the case.

Aviles, also known as ‘Ricardo Bermudez,’ is charged with possession of a firearm by a convicted felon, a charge that carries a maximum penalty of 10 years in prison and a maximum fine of $250,000.

The government credited special agents of the Bureau of Alcohol, Tobacco, Firearms & Explosives, Newark Field Division, under the direction of Special Agent in Charge Jeffrey L. Matthews, and the Elizabeth Police Department with the investigation leading to the charge.

Assistant U.S. Attorney Sarah A. Sulkowski of the Violent Crimes Unit in Newark represents the government in the case.

Aviles made his initial appearance before U.S. Magistrate Judge Leda Dunn Wettre in Newark federal court on December 13, 2021, and was detained without bond.

The charge and allegations contained in the complaint are merely accusations, and Aviles is presumed innocent unless and until proven guilty.
