AGPTEK, an online merchant, has agreed to pay $1,049,635.82 for failing to pay postage on large amounts of mail sent through the United States Postal Service.

The settlement, announced by US Attorney Robert L. Capers and Philip R. Bartlett, Inspector-in-Charge of the New York Division of the US Postal Inspection Service, resolved a multi-year investigation into AGPTEK’s mailings to consumers.

Between June 2005 and May 2010, AGPTEK mailed over 200,000 items to customers either without postage or with insufficient postage. The company would stamp packages with an unauthorized postal permit number, not associated with any credit card or billing account.

AGPTEK and its principal, Charlie Wang, accepted responsibility for failing to pay sufficient postage during the five-year period.

“By failing to pay proper postage, AGPTEK short-changed the Postal Service of funds it depends on from customers to fulfill its mission,” said US Attorney Capers.

The Postal Inspection Service will continue to pursue individuals who underpay the Postal Service, and US Attorney Capers’ strong stance against those who seek to take advantage of the Postal Service is appreciated.

This case was investigated by the US Postal Inspection Service and handled by Assistant US Attorney Rachel G. Balaban.

As part of the agreement, AGPTEK and Mr. Wang will pay the $1.05 million to resolve the civil allegations.

This is a clear example of corporate greed and disregard for the law.
