Nigel Kenneth Joseph, $5 Million Payroll Tax And Wire Fraud, New York 2021

Nigel Kenneth Joseph, the president of a Bronx-based construction company, has been charged with a $5 million payroll tax and wire fraud scheme.

According to a 14-count complaint, Joseph, 43, failed to pay payroll taxes for his employees at BWK, a masonry subcontractor, and used company funds to finance his own lifestyle.

The complaint alleges that Joseph used tens of thousands of dollars to transfer to his wife, made personal rental payments, purchased a Rolex and NBA tickets, and leased luxury vehicles, including a BMW 3-Series, a Mercedes GLE, and a BMW 5-Series.

Joseph also directed employees to produce falsified certified payroll documents to obtain payments from construction contractors, resulting in approximately $1.96 million in fraudulent payments.

The scheme occurred between 2019 and 2021, during which time BWK earned at least $10 million performing construction in New York, New Jersey, and Connecticut.

Joseph was arrested and presented before U.S. Magistrate Judge Ona T. Wang on [date].
