Nogales Man Hit with 32-Month Sentence for Gunpoint Standoff

TUCSON, Ariz. – In a chilling incident that had the border town of Nogales on edge, Erik Alberto Beal, 28, was sentenced yesterday to 32 months in prison for pointing a firearm at a federal Border Patrol agent. This brazen act of violence against law enforcement has once again highlighted the dangers faced by agents patrolling our nation’s borders.

The harrowing encounter unfolded on April 11, 2024, when two Border Patrol Agents were tracking an illegal alien near Beal’s residence in Nogales. While investigating the area around Beal’s home, a pit bull was released towards one of the agents. The agent responded by drawing his firearm and shouting warnings. It was then that Beal emerged from his house with a semi-automatic handgun, chambering a round before pointing it at the uniformed officer.

The situation quickly escalated into a tense standoff until the arrival of a second Border Patrol agent, who also drew his weapon. The threat was neutralized only after both agents displayed their service firearms to Beal, compelling him to surrender his own weapon.

United States District Judge Angela Martinez handed down the sentence, which also includes 36 months of supervised release. Beal had previously pleaded guilty to Assault on a Federal Officer. The investigation into this case was led by the FBI Phoenix Division’s Tucson office, with support from Customs and Border Protection and the Office of Professional Responsibility.

Assistant U.S. Attorneys Micah Schmit and Serra Tsethlikai prosecuted the case in Tucson. Beal now faces a lengthy prison term for his reckless actions that could have had deadly consequences on our nation’s border security forces.
