North Dakota Man Charged with Abusive Sexual Contact

Bismarck, ND – A federal indictment has been filed against Brandon Wutzke, 28, of Bismarck, North Dakota, for Abusive Sexual Contact. United States Attorney Brendan V. Johnson announced the indictment on December 10, 2013.

According to the indictment, Brandon Wutzke knowingly engaged in sexual contact with a female who had not yet attained the age of 16 years on or about December 25, 2012. This act is punishable by up to 2 years in custody and a $250,000 fine. Wutzke also faces a mandatory minimum of 5 years of supervised release and a $100 contribution to the Federal Crime Victims Fund.

The investigation into this case is being led by the Federal Bureau of Investigation. Assistant U.S. Attorney Troy R. Morley is prosecuting the case. Wutzke has been released on bond pending trial, but a trial date has not been set.

The charge against Wutzke is merely an accusation, and he is presumed innocent until proven guilty. Restitution may also be ordered if Wutzke is found guilty.
