Abusive Sexual Contact Lands Bismarck Man Behind Bars
A 29-year-old North Dakota man has been sentenced to 3 months of custody, 5 years of supervised release, and a $100 special assessment to the Federal Crime Victims Fund for his role in an incident of abusive sexual contact.
Brandon David Wutzke, of Bismarck, was sentenced by U.S. District Judge Charles B. Kornmann on June 9, 2014, following his guilty plea to the charge. The conviction stems from an incident that occurred on December 25, 2012, at Wutzke’s parents’ home in McLaughlin, South Dakota.
According to court documents, Wutzke was 28 years old at the time of the incident and the victim was just 12 years old. The victim reported that Wutzke fell asleep in the living room with her and two other children, but at some point during the evening, he reached under her shirt and bra and touched her inappropriately. The victim awoke to find Wutzke lying beside her and immediately reported the incident to her parents.
The case was investigated by the Federal Bureau of Investigation, and Assistant U.S. Attorney Troy R. Morley prosecuted the case. Wutzke is required to self-report to the U.S. Marshals Service by June 24, 2014.
The incident has left many in the community feeling shocked and disturbed. ‘This is a heinous crime that has caused irreparable harm to the victim,’ said a local resident. ‘We hope that Wutzke’s sentencing will bring a sense of justice and closure to the family.’
