NY AG James Slams Price Gouging Before Winter Storm

New York Attorney General Letitia James has issued a stern consumer alert, cautioning residents about the potential for price gouging ahead of an impending winter storm. With Governor Hochul declaring a state of emergency across New York, AG James is reminding businesses that the state’s price gouging law strictly prohibits excessive pricing during market disruptions or emergencies.

“Winter weather is no excuse for price gouging,” AG James stated. “As New Yorkers prepare for another snowstorm, my office is on high alert for those looking to exploit consumers through excessive price hikes.” The Attorney General encourages vigilance and swift reporting of any instances of price gouging directly to the Office of the Attorney General (OAG).

Under New York law, businesses are forbidden from taking unfair advantage of consumers by selling essential goods or services at unconscionably high prices during emergencies. This includes, but is not limited to, food, water, gasoline, generators, batteries, flashlights, hotel lodging, and transportation options. The price gouging law applies to vendors, retailers, and suppliers across the state.

When filing a complaint with the OAG, consumers are advised to provide specific details such as increased prices, dates, locations, and copies of sales receipts or photos of advertised prices if possible. Violations of the price gouging law can result in penalties up to $25,000 per violation.

New Yorkers who suspect price gouging are encouraged to report their concerns to the OAG by filing an online complaint or calling 800-771-7755.
