NY AG James Takes on Unconstitutional Birthright Citizenship Order

New York – In a bold legal move, New York Attorney General Letitia James announced today that she, along with a coalition of 18 states and the City of San Francisco, are challenging President Donald Trump’s Executive Order aimed at ending birthright citizenship. The lawsuit was filed in the U.S. District Court for the District of Massachusetts to halt what they argue is an unconstitutional action.

“The great promise of our nation is that everyone born here is a citizen of the United States,” said Attorney General James. “President Trump’s attempt to undermine birthright citizenship is not just unconstitutional, it is profoundly dangerous.”

The coalition seeks to invalidate the Executive Order and obtain immediate relief through a Preliminary Injunction to prevent its implementation. Birthright citizenship has been enshrined in the U.S. Constitution since the adoption of the 14th Amendment following the Civil War, which guarantees citizenship for children born in the country regardless of their parents’ immigration status.

The Executive Order, if allowed to stand, would strip citizenship from babies born in the United States to parents who are either lawfully present on certain visas or undocumented. This would mean a loss of basic rights and benefits for these children, including eligibility for federal programs, Social Security numbers, lawful employment, access to healthcare, and food benefits.

Joining Attorney General James in this lawsuit are the attorneys general of California, Colorado, Connecticut, Delaware, Hawaii, Maine, Maryland, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New Mexico, North Carolina, Rhode Island, Vermont, Wisconsin, and the District of Columbia, as well as San Francisco. Special Counsel for Immigrant Justice Zoe Levine, Special Counsel for Federal Initiatives Rabia Muqaddam, and Special Counsel Molly Thomas-Jensen are handling the case for New York.

This legal battle is seen as a crucial defense of one of America’s most fundamental rights, ensuring that the promise of birthright citizenship remains intact for all children born in the United States.
