NY AG Sues to Block ACA Rule: Health Care Crisis Averted?

New York – In a dramatic move to protect the Affordable Care Act (ACA), New York Attorney General Letitia James has filed a lawsuit against a federal regulation that poses a severe threat to health care coverage for millions of Americans. The lawsuit, filed in conjunction with 20 other states, aims to block a rule from the U.S. Department of Health and Human Services (HHS) and Centers for Medicare and Medicaid Services (CMS) that seeks to dismantle key ACA protections.

Attorney General James labels the proposed regulation an ‘illegal and dangerous attack on health care access,’ arguing that it would strip coverage from working families, impose red tape, and disproportionately impact low-income and transgender Americans. ‘In New York, we have expanded coverage and protected our citizens’ health. The federal government should be learning from our success, not undermining it,’ she asserts.

The ACA was enacted in 2010 to increase health insurance access and reduce costs for individuals and families, establishing state-level marketplaces and requiring plans to cover essential health benefits. Over the past five years, enrollment has doubled, with over 24 million Americans enrolled this year alone, many receiving subsidies to make coverage more affordable.

However, HHS and CMS’s new rule is set to take effect in August, potentially stripping coverage from up to two million people. It shortens open enrollment periods, eliminates year-round enrollment for low-income individuals, adds extensive paperwork, and makes health care tax credits harder to access. Additionally, the rule limits automatic reenrollment and imposes illegal monthly charges on zero-dollar premium plan consumers.

Furthermore, the regulation bars states from including gender-affirming care in the list of essential health benefits under the ACA. This discriminatory policy could have serious repercussions for transgender youth and young adults, as research indicates that access to gender-affirming care reduces mental health issues among this population. New York state law prohibits discrimination based on gender identity, directly conflicting with the federal rule.

Attorney General James’s lawsuit seeks to block the implementation of this damaging rule, emphasizing its potential to devastate state health systems and endanger public health. The legal challenge underscores the ongoing battle to preserve the ACA and ensure access to affordable health care for all Americans.
