NY AG Sues to Block Defunding of Planned Parenthood

New York – In a bold move against what they call the ‘One Big Beautiful Bill Act’, New York Attorney General Letitia James has joined forces with 21 other state attorneys general and Pennsylvania to sue the federal government. The lawsuit aims to block a provision of the act that targets Planned Parenthood, defunding it for advocating abortion rights.

The OBBA, enacted on July 4, bars Medicaid funding from clinics receiving substantial Medicaid funds and providing abortions—a criterion that predominantly affects Planned Parenthood. AG James and her coalition argue this is an unconstitutional attack on healthcare and reproductive freedom, disproportionately impacting low-income communities.

“The federal government is playing politics with our health care system,” said AG James. “This illegal targeting of Planned Parenthood will make it harder for millions to get the care they need.”

In 2023, 89,000 New Yorkers accessed essential healthcare services at Planned Parenthood clinics, including cancer screenings and STI testing. The coalition fears cutting off funding would devastate access, especially for vulnerable populations.

The lawsuit also argues that the law violates the First Amendment, the Spending Clause, and the Constitution’s ban on bills of attainder by singling out Planned Parenthood without due process.

The attorneys general seek a court order declaring the defunding provision unconstitutional and halting its implementation.
