BANGOR, MAINE – Rocky Allen Resides, 27, of Xenia, Ohio, learned a harsh lesson about proper border procedures today, receiving a time-served sentence in U.S. District Court after admitting to illegally entering the United States without reporting to a designated crossing point. The case, handled by Assistant United States Attorney Andrew McCormack, highlights the ongoing efforts of federal authorities to secure the northern border.
According to court records, the scheme unraveled on April 2, 2017, when U.S. Border Patrol agents spotted Resides walking along U.S. Route 1 in Calais, Maine, a stone’s throw from the Canadian border. The seemingly innocuous pedestrian turned out to be a fugitive from proper immigration procedures. Agents quickly discovered a deeper issue: Resides hadn’t simply overstayed a visa; he’d entered Canada illegally in July 2016.
Instead of re-entering the U.S. legally, Resides attempted to bypass the system entirely. He crossed back into the States from Canada without reporting to a border crossing, effectively sidestepping inspection and potential legal scrutiny. This deliberate act of evasion formed the core of the federal charge. Magistrate Judge John C. Nivison determined that time already served constituted sufficient punishment for the offense.
The details of Resides’ initial illegal entry into Canada remain murky. Federal investigators have not released information regarding how he initially crossed the border, or his activities during his time in Canada. What is clear is that his attempt to return to the United States without proper documentation triggered a swift response from the Border Patrol, initiating an investigation that ultimately led to his conviction.
While the sentence appears lenient – time served – it’s a clear indication that federal authorities are taking border security seriously, even in less publicized areas like the Maine-Canada frontier. The U.S. Attorney’s Office, led by Acting United States Attorney Richard W. Murphy, emphasized the importance of adhering to all immigration laws and regulations. Resides’ case serves as a warning to others contemplating similar actions.
The investigation was solely conducted by the dedicated agents of the U.S. Border Patrol. McCormack can be reached at (207) 945-0373 for further inquiries. The Grimy Times will continue to monitor federal prosecutions along the nation’s borders, exposing the realities of cross-border crime.
