The couple, owners of Rocky’s New York Pizza in Hagerstown, Maryland, landed in federal court today and admitted to deliberately dodging their tax obligations.
According to United States Attorney William J. Ihlenfeld, II, the Picones failed to file personal income tax returns for the years 2010 and 2011. It’s a classic playbook: rake in the dough, skip the filings, and hope you don’t get caught. But the IRS – Criminal Investigation division isn’t known for its forgiving nature.
Both Frank and Toni Picone each pled guilty to two counts of “Failure to File a Personal Income Tax Return.” Each count carries a potential sentence of up to one year in prison and a fine of up to $100,000.00. That’s $200,000 in fines *and* two years potentially lost to incarceration for neglecting a basic civic duty.
While the Federal Sentencing Guidelines will ultimately determine the final sentence, it will be based on the severity of the offenses and any prior criminal history the couple may have. A clean record might offer some leniency, but the IRS doesn’t play games when it comes to lost revenue.
