Randy Metcalf, Assault, Iowa 2015

A brutal and racially motivated hate crime has resulted in a maximum prison sentence for the perpetrator. Randy Metcalf, 40, from Dubuque, Iowa, was sentenced to 10 years in federal prison for repeatedly stomping on and kicking the head of an African American man.

The evidence presented at trial showed that on January 12, 2015, Metcalf had been using racial slurs in reference to the African American man at a bar in Dubuque. Metcalf also displayed a swastika tattoo and bragged about having burned crosses. Later that night, Metcalf assaulted the victim, repeatedly stomping on and kicking his head as he lay barely conscious on the floor of the bar.

Metcalf was pushed away from the victim by another person in the bar but returned to continue the assault, kicking and stomping the victim in the head again. This vicious attack has been condemned by law enforcement and government officials, who have reaffirmed their commitment to protecting the rights and freedoms of all people.

United States Attorney Kevin W. Techau stated after sentencing, “The Department of Justice is committed to protecting the rights and freedoms of all people. Hate crimes represent an attack not just on the individual victim but also on the entire community. The federal hate crime of which Randy Metcalf was found guilty is as reprehensible as it was violent. We will continue to use every tool at our disposal to vindicate the rights of victims of violent hate crimes.”

Principal Deputy Assistant Attorney General Vanita Gupta, head of the Justice Department’s Civil Rights Division, also commented on the case, saying, “This vicious attack threatened the most basic standards of human decency and dignity. While no sentence, including this one, can undo the harm inflicted, it does send an unequivocal message that the Justice Department will vigorously prosecute hate crimes.”

The case was investigated by the Dubuque Police Department and the Federal Bureau of Investigation. It was jointly prosecuted by Assistant United States Attorney Anthony Morfitt and Trial Attorney Christopher Perras of the Justice Department’s Civil Rights Division. Metcalf was sentenced in Cedar Rapids by United States District Court Chief Judge Linda R. Reade to 120 months’ imprisonment, a special assessment of $100, and ordered to make $1874.56 in restitution to the victim. He must also serve a three-year term of supervised release after the prison term.
