Albert Kelly II, Misprision of a Felony, South Dakota 2014

Rapid City, SD – A local man’s attempt to cover up a crime has landed him in hot water. Albert Kelly II, a 51-year-old Rapid City resident, was sentenced to 5 months of home confinement and 7 months of supervised release for his role in concealing a felony.

According to court documents, Kelly and his co-defendant went to the victim’s home on the Rosebud reservation on May 10, 2013. While Kelly waited outside, his co-defendant entered the home and assaulted the victim.

kelly and his co-defendant were indicted by a federal grand jury on July 17, 2013, for First Degree Burglary and Assault with a Dangerous Weapon. However, Kelly ultimately pled guilty to Misprision of a Felony on April 1, 2014.

The case was investigated by the Federal Bureau of Investigation and the Rosebud Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Marie H. Ruettgers prosecuted the case.

Kelly was sentenced by U.S. District Judge Roberto A. Lange on June 30, 2014. In addition to his home confinement and supervised release, Kelly was also ordered to pay a $500 fine and a $100 special assessment to the Federal Crime Victims Fund.

Kelly’s co-defendant’s current whereabouts are unknown, and it is unclear whether they are facing any charges related to the assault.

The case serves as a reminder that attempting to cover up a crime will not go unpunished. Kelly’s sentence is a stern warning to those who think they can hide behind the law.
