A Rapid City Man’s Descent into Crime
A Rapid City man was sentenced to prison for illegally possessing a firearm, despite being a prohibited person due to a previous felony conviction.
Darius Emery, 33, was sentenced to two years and three months in federal prison, followed by three years of supervised release, and a $100 special assessment to the Federal Crime Victims Fund.
The crime dates back to August 2019 and June 2020, when Emery came into contact with Rapid City Police Department officers. During these encounters, police found a semi-automatic pistol and a double-action revolver in Emery’s possession.
Emery was indicted by a federal grand jury on January 12, 2021 and pleaded guilty on May 7, 2021. The case is part of Project Safe Neighborhoods (PSN), a strategy aimed at reducing violent crime.
The investigation was conducted by the Bureau of Alcohol, Tobacco, Firearms, and Explosives and the Rapid City Police Department. Assistant U.S. Attorney Benjamin Patterson prosecuted the case. Emery was immediately turned over to the custody of the U.S. Marshals Service.
With this conviction, the community can rest assured that those who break the law will face the consequences. As part of the PSN strategy, law enforcement agencies and community partners work together to address violent crime and support prevention and reentry programs.
As the investigation and trial demonstrate, the authorities will not tolerate individuals who put themselves and others at risk by possessing firearms despite being prohibited from doing so.
