Arvin Red Bear, Assault with a Dangerous Weapon and Assault Resulting in Serious Bodily Injury, South Dakota 2014

An Eagle Butte man has been charged with a serious crime, leaving a victim with serious bodily injury. 52-year-old Arvin Red Bear, Sr. has been indicted by a federal grand jury for Assault with a Dangerous Weapon and Assault Resulting in Serious Bodily Injury.

According to court documents, the alleged assault occurred on or about June 29, 2014. Red Bear, 52, allegedly used a dangerous weapon to assault a male victim, resulting in serious bodily injury.

Red Bear was indicted on November 13, 2014, and appeared before U.S. Magistrate Judge Mark A. Moreno on November 20, 2014. He has pled not guilty to the Indictment.

The maximum penalty upon conviction is up to 10 years in custody and/or a $250,000 fine, 3 years of supervised release, and a $200 special assessment to the Federal Crime Victims Fund. Restitution may also be ordered.

The investigation is being conducted by the Cheyenne River Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Troy R. Morley is prosecuting the case. Red Bear was released on bond pending trial. A trial date has not been set.

Red Bear is presumed innocent until and unless proven guilty. The charges are merely accusations. It is the responsibility of the court to determine guilt or innocence.
