Red Hill Fuels Employees Indicted for Fuel Spill False Statement

HONOLULU – A major scandal has erupted at the Red Hill Bulk Fuel Storage Facility as two top employees face federal charges for a colossal cover-up. John Floyd, 63, of Mililani, and Nelson Wu, 38, from Waipahu, have been indicted by Acting United States Attorney Ken Sorenson for conspiracy to commit an offense against the U.S. and making a false statement to the Hawaii Department of Health.

According to the indictment, Floyd and Wu were employed as the Fuels Department Deputy Director and Supervisory Engineer at the time of a jet fuel spill on May 6, 2021. The pair is accused of falsely stating that only 1,618 gallons of jet fuel spilled, when they knew the actual amount was 20,000 gallons. This deception occurred in response to a request for information (RFI) from the Hawaii Department of Health.

The spill at Red Hill, which is under the regulatory purview of the United States Environmental Protection Agency, was a significant environmental concern. The defendants’ actions are alleged to have concealed crucial information and records related to the incident.

Both Floyd and Wu face a maximum sentence of five years’ imprisonment and a fine of up to $250,000 for each charge if convicted. However, they are presumed innocent until proven guilty beyond a reasonable doubt in court.

The investigation into this case has been a collaborative effort involving multiple agencies, including the Defense Criminal Investigative Service, the Naval Criminal Investigative Service, the Environmental Protection Agency’s Criminal Investigation Division, and its Office of the Inspector General. Assistant U.S. Attorney Craig S. Nolan is leading the prosecution.
