Roosevelt Care Centers Sued for Disability Discrimination
A federal lawsuit against Roosevelt Care Centers has been settled for $50,000, after the New Jersey nursing home was accused of discriminating against a dietary worker due to her disability.
The U.S. Attorney’s Office for the District of New Jersey filed a proposed consent decree on March 20, 2023, to resolve the lawsuit against Roosevelt Care Centers, which alleged that the nursing home unlawfully terminated an employee based on her disability.
The complaint, filed in federal court on March 20, 2023, claimed that the employee, who had been working at Roosevelt Care Centers for approximately 18 years, was terminated due to her inability to lift objects heavier than 20 pounds, despite being able to perform the essential functions of her position.
Under the terms of the consent decree, which must be approved by the court, Roosevelt Care Centers has agreed to pay $50,000 in compensation to the complainant and to train its staff on the Americans with Disabilities Act (ADA).
The settlement also requires Roosevelt Care Centers to periodically submit reports about its compliance with the consent decree.
U.S. Attorney Philip R. Sellinger praised the settlement, saying, “Qualified individuals with disabilities must be given an equal opportunity to be part of the workforce. This settlement reflects the U.S. Attorney’s Office’s commitment to ending discriminatory employment practices and protecting the civil rights of all employees under the Americans with Disabilities Act.”
Roosevelt Care Centers is a nursing home based in New Jersey, and the lawsuit was handled by the U.S. Attorney’s newly formed Civil Rights Division, based on a referral from the Newark Area Office of the Equal Employment Opportunity Commission.
