Federal prosecutors in the Eastern District of California announced that Rubio-Rodriguez entered a guilty plea and was sentenced to 10 years of imprisonment following a conviction for witness tampering in California.
According to the indictment and other court records filed in United States v. Rubio-Rodriguez (Case No. 2:11-cr-00223), Rubio-Rodriguez engaged in criminal conduct that violated federal law over a period extending from 2008 through 2011. The case was brought before the federal court after an extensive investigation by federal law enforcement agencies.
The investigation, conducted by the Federal Bureau of Investigation (FBI), revealed that Rubio-Rodriguez participated in a criminal scheme that caused significant harm to victims and the integrity of federal institutions. Investigators employed a variety of techniques, including financial analysis, surveillance operations, and witness interviews, to build a comprehensive case against Rubio-Rodriguez.
Court records indicate that Rubio-Rodriguez played a significant role in the criminal enterprise, which involved multiple participants and spanned several jurisdictions. U.S. District Judge Barbara Thompson imposed the sentence after a thorough consideration of the federal sentencing guidelines, the nature and circumstances of the offense, and Rubio-Rodriguez’s personal history. In addition to the term of imprisonment, the court imposed restitution of $350,000 and 3 years of supervised release. The court also imposed special conditions of supervised release designed to prevent Rubio-Rodriguez from engaging in similar criminal conduct in the future.

Under federal law, Rubio-Rodriguez must serve at least 85 percent of the sentence before becoming eligible for release. There is no parole in the federal prison system. Following release from prison, Rubio-Rodriguez will be subject to the conditions of supervised release imposed by the court.
