According to court records, Fialdini moved to Sacramento in August 2015—fully aware he was legally required to register under the Sex Offender Registration and Notification Act (SORNA). He didn’t. The reason? A trail of convictions for open and gross lewdness in Nevada, including a 2009 conviction for sexual battery against a woman and another for committing an intentional sex act in public. Those crimes demanded accountability. He refused to provide it.

His silence didn’t last. On November 30, 2015, Fialdini exposed himself to an adult woman in broad daylight in Sacramento—another brazen act from a man already on federal radar. Local authorities flagged the incident, and investigators began connecting the dots. By March 8, 2016, U.S. Marshals, working with the Sacramento County Sheriff’s Sex Assault Felony Enforcement (SAFE) Team, arrested Fialdini in a county park.

The SAFE Team, a multi-agency task force focused on tracking down fugitive sex offenders and enforcing registration laws, played a central role in the investigation. Their work underscores a grim reality: hundreds of registered sex offenders vanish each year, and only aggressive, coordinated law enforcement brings them in. Fialdini’s case is not an anomaly—it’s a warning.

Assistant U.S. Attorney Michelle Rodriguez is prosecuting the case, which was built on federal jurisdiction due to interstate movement and SORNA violations. Fialdini now faces up to 10 years in federal prison—a maximum penalty that reflects the seriousness of evading oversight meant to protect communities.

Sentencing is set for April 27, 2017, before U.S. District Judge Morrison C. England Jr. While the court will weigh statutory factors and the Federal Sentencing Guidelines, one fact remains unshakable: Fialdini chose to disappear. The sentence will determine how long he stays off the streets.
