Roy A. Nelson, Clean Air Act Violations, Massachusetts 2006

WASHINGTON – A Massachusetts company has reached a settlement with the U.S. government over Clean Air Act penalties and repayment of cleanup costs from a 2006 explosion at its Danvers facility.

The U.S. Environmental Protection Agency (EPA) announced today that Sartorelli Realty LLC, along with former operator C.A.I. Inc. and Roy A. Nelson as Trustee of the Nelson Danvers Realty Trust, will pay the U.S. Government a projected $1.3 million to settle allegations of Clean Air Act violations.

The fine is part of a consent decree lodged by the EPA, which alleges that the company’s Danvers facility exploded and burned on November 22, 2006, violating the General Duty Clause of the Clean Air Act. The explosion and subsequent fire destroyed the 12,000 square foot building, and the surrounding commercial and residential community experienced significant structural and property damage from the blast.

As part of the settlement, C.A.I. Inc. will pay a $100,000 penalty to the EPA. The majority of the $1.3 million recovery will go towards reimbursing the EPA for its $2.7 million in costs of cleaning up hazardous waste after the explosion.

The incident occurred on November 22, 2006, in Danvers, Massachusetts. The explosion and subsequent fire destroyed the facility and caused significant damage to the surrounding community.

The settlement underscores the importance of industry’s compliance with the law to ensure the protection of human health and the environment. The EPA’s investigation and cleanup action were undertaken as a result of the explosion and chemical fire that occurred at the C.A.I. and Arnel industrial building in Danvers.
