SAN SIMEON, CA – A northern elephant seal met a brutal end on a California beach in 2019, and now the alleged perpetrator is facing the music. Jordan Gerbich, 30, of Santa Maria, has been charged with one count of taking a marine mammal – a federal offense under the Marine Mammal Protection Act – for the cold-blooded shooting of the animal near San Simeon.
The grim discovery was made in September 2019, just off Highway 1, a popular viewing spot for these massive creatures. Authorities found the carcass of the northern elephant seal, a protected species, riddled with a single gunshot wound to the head. The location, near a well-known rookery, suggests a deliberate act, not a hunting accident. These rookeries, crucial breeding and molting grounds, are consistently populated but experience fluctuations based on the animal’s life cycle.
According to court documents filed by the Department of Justice, Gerbich allegedly committed the act on September 28, 2019. While the motive remains unclear, the act itself carries serious consequences. Northern elephant seals, vulnerable to population decline, are specifically protected by federal law, making their intentional harm a federal crime.
An information, a document outlining the charges, states that Gerbich is presumed innocent until proven guilty beyond a reasonable doubt. However, if convicted of this misdemeanor offense, he could face a statutory maximum sentence of one year in federal prison. This isn’t a slap on the wrist; the feds are making an example of anyone who targets protected species.
The investigation, led by the National Oceanic and Atmospheric Administration’s Office of Law Enforcement, received significant support from the California Department of Fish and Wildlife. These agencies worked meticulously to gather evidence and build a case against Gerbich, highlighting the importance of interagency cooperation in tackling wildlife crime.
Assistant United States Attorney Heather C. Gorman of the Environmental and Community Safety Crimes Section is prosecuting the case. This prosecution sends a clear message: harming protected marine mammals will not be tolerated. The Grimy Times will continue to follow this case and provide updates as they become available, exposing the darkness lurking beneath the surface of even seemingly isolated incidents.
