Stilwell Man Gets Ten Years for Voluntary Manslaughter

MUSKOGEE, OKLAHOMA – A chilling tale of violent retribution has come to a close in the Eastern District of Oklahoma. Mose Adam Smith, 43, of Stilwell, was sentenced to 121 months in prison for Voluntary Manslaughter in Indian Country. The sentence comes after a heinous incident that left one man dead and two lives irrevocably altered.

Smith’s conviction stemmed from an investigation by the Federal Bureau of Investigation, Sequoyah County Sheriff’s Office, Grant County Sheriff’s Office, and the Wisconsin State Crime Laboratory. On July 17, 2023, Smith was involved in a violent altercation at a Sallisaw residence that led to the victim’s death due to blunt force trauma.

The aftermath saw Smith, along with co-defendant Kimberly Dawn Ball-Gilbert, flee the state in the victim’s truck. Their flight came to an end ten days later when law enforcement officers apprehended them in Illinois. The crime occurred within Sequoyah County, part of the Cherokee Nation Reservation, under the Eastern District of Oklahoma.

Ball-Gilbert, 42, also of Stilwell, pleaded guilty on March 19, 2025, to aiding and abetting Smith’s actions in causing the victim’s death. Her sentencing is pending. The Honorable Ronald A. White presided over Smith’s hearing, ensuring that justice was served.

The sentence handed down by Judge White means that Smith will serve a non-paroleable term in federal custody. Assistant U.S. Attorneys Patrick M. Flanigan and Lewis M. Reagan represented the United States throughout the proceedings.

This case serves as a stark reminder of the consequences of violence and the relentless pursuit of justice by federal law enforcement agencies.
