Tabari Facen, Drug Trafficking, New York 2011

Rochester, NY – In a major blow to the city’s ongoing struggle with crime, Tabari Facen, 36, has been convicted of possessing 28 grams or more of crack cocaine with intent to distribute, maintaining a drug-involved premises, possessing a firearm in furtherance of drug trafficking crimes, and possessing a firearm and ammunition while being a convicted felon.

According to the U.S. Attorney’s Office, the defendant was arrested on September 26, 2011, after a search warrant was executed at 303 Lakeview Park in Rochester. Officers from the Greater Rochester Area Narcotics Enforcement Team found over 53 grams of crack cocaine, paraphernalia used to distribute crack cocaine, a loaded .40 caliber Smith & Wesson handgun, two loaded handgun magazines, and over 100 rounds of ammunition.

Facen, who has a prior state drug trafficking conviction, faces a mandatory minimum penalty of 15 years in prison, a maximum of life, an $8,000,000 fine or both.

The conviction is the result of an investigation by the Greater Rochester Area Narcotics Enforcement Team, composed of law enforcement personnel from the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Rochester Police Department, and the Brighton Police Department.

U.S. Attorney William J. Hochul, Jr. praised the efforts of the law enforcement agencies involved in the case, stating that the defendant’s removal from the community will help to reduce violence in Rochester.

Sentencing is scheduled for September 4, 2013, before U.S. District Court Judge David G. Larimer.
